Additional Terms for Managed Nextcloud Hosting
1. Scope
1.1 These additional terms apply to all managed Nextcloud hosting services provided by YourData Network BV (“the Provider”) through the website yourdata.network.
1.2 These terms complement the general Terms and Conditions of YourData Network BV and apply specifically to managed installations running on the decentralized internet infrastructure (“the Grid”).
1.3 In case of any inconsistency between these terms and the general Terms and Conditions, these additional terms shall prevail for managed Nextcloud services.
2. Nature of the Service
2.1 By ordering a managed Nextcloud service, the customer authorizes YourData Network BV to deploy, configure, and maintain one or more virtual machines (VMs) on the Grid, which may include both a main instance and one or more backup environments.
2.2 The Provider ensures correct technical deployment, updates, and maintenance of these environments as part of the managed service.
3. Technical Access
3.1 To perform installation, configuration, and maintenance, the Provider requires administrative access to the customer’s environments.
3.2 Due to the nature of decentralized hosting and the underlying smart contract, it is technically impossible to revoke this access without destroying the installation, which would result in the complete loss of all stored data.
3.3 The Provider does not access or view any personal content stored by the customer, except when strictly necessary to provide technical support or resolve a malfunction.
4. Data Ownership and Responsibility
4.1 All data stored within the managed environments remain the exclusive property and responsibility of the customer.
4.2 The Provider does not claim any ownership rights and acts solely as a technical facilitator to enable the service.
4.3 The customer acknowledges that data integrity and security within their Nextcloud environment ultimately remain their responsibility.
5. Confidentiality
5.1 YourData Network BV shall maintain strict confidentiality regarding all customer data or information that may be accessible during technical maintenance.
5.2 Any access is used exclusively for installation, updates, troubleshooting, or support purposes and is handled in accordance with GDPR and relevant data protection legislation.
6. User Consent
6.1 By checking the acceptance box during the ordering process, the customer confirms and agrees that:
- YourData Network BV maintains limited administrative access required for proper functioning and maintenance of the service.
- Such access cannot be fully revoked without deleting the hosted environments, including any backups.
- The Provider acts solely as a technical facilitator and not as a data controller under GDPR.
7. Liability and Governing Law
7.1 YourData Network BV cannot be held liable for data loss or service interruption resulting from user actions, revoked access, or deletion of the environment due to termination of the smart contract.
7.2 These additional terms are governed by Dutch law. Disputes shall be submitted to the competent court in Arnhem, the Netherlands.
